Overview

Each time Member accesses any of the Spuggz/POND/SUFR (Herein known as Spuggz/POND/SUFR) Forums, Member accepts the Forum Terms and Conditions and agrees to be bound by them. Member should not continue to use any Spuggz/POND/SUFR Forum should Member not agree to accept all of the Forum Terms and Conditions stated in this Agreement. A Member should not submit any User Content (posts, comments, images, videos, or materials) to any Forum site, or download any materials from them. Please carefully review the following rules that govern Member’s use of our Forum sites.  Please note that unless Forum Terms & Conditions have been accepted, Member’s use of any of the Spuggz/POND/SUFR Forums constitutes Member’s unconditional agreement to follow and be bound by these Terms and Conditions. 

Spuggz requires that a Forum user registers and becomes a Member of a Spuggz program before we accept or publish any User Content such as posts, comments, submitted materials, or any interaction on the Forum sites.  Visitors to the website can view limited Forum content.

Views & Opinions

The views expressed on our Forums are the personal opinions, stories and experiences of the Members and Spuggz representatives named in each post. Content posted may not represent the views or opinions of Spuggz, its owners or representatives, affiliates, sponsors, or other Members of the Forum, unless specifically stated.

Intent

It is the intent of Spuggz to provide a supportive and safe environment where Members, coaches, and administrative personnel can safely communicate through our forums.

Spuggz/POND/SUFR provides a range of topics, categories, conversation starters, responses, and views from multiple sources for the purpose of assisting and supporting people in need of some type of life recovery, recovery from addiction, depression, anxiety, emotional disorders, trauma, as well as those in need of aftercare support.  This can include those currently suffering from an addiction, depression, anxiety, emotional distress, or trauma, as well as those who have recovered and need aftercare, and family, friends, co-workers, and employers of those who are suffering, or have suffered.

User Content

Anything a Member posts, shares, or uploads to any of the Forums, is considered to be User Content.  This includes, but is not limited to, posts, text, comments, images, videos, or any type of material uploaded, and any interaction shared on the recovery Forum.

TRIGGER WARNING

Please be aware that content posted on our forums by other Members, Spuggz/POND/SUFR moderators and representatives, and guests, may be upsetting in nature and readers should be cautioned that content such as comments, videos, images, or downloaa Postbe disturbing and may cause intense physiological and psychological symptoms for people with a  Post-Traumatic Stress Disorder (PTSD), those battling an addiction and other anxiety or emotional disorders.

Trigger Warning Continued

PTSD, along with addiction and other emotional disorders, are real mental health disabilities that have physical, emotional, and mental symptoms that can be triggered by stimuli that recalls an individual’s experience of trauma. While individuals may not have control over what triggers them, a personal strategy on how cope with triggers can help an individual prepare in advance for a potential trigger, or an event caused by a trigger. If Member suffers from addiction, PTSD, or other anxiety or emotional disorders, they are encouraged to use extreme caution when viewing, reading, or interacting with any of the Spuggz forums.

SUICIDAL THOUGHTS AND EMOTIONAL DISTRESS

Should Member have suicidal thoughts, be in emotional distress, or believe there is a potential danger to themselves, or to another, Member is strongly encouraged to call a professional for help. Dial 911 if you, or someone you know, is in eminent danger. 

If Member, or someone they know, is suicidal or in emotional distress, contact the National Suicide Prevention Lifeline. Trained crisis workers are available to talk 24 hours a day, 7 days a week. Calls are confidential and toll-free and go to the nearest crisis center in the Lifeline national network. If someone has overdosed and has serious symptoms such as passing out or trouble breathing, call 911 immediately. Additional symptoms of overdose may include slow heartbeat, shallow breathing, severe drowsiness, dizziness, confusion, muscle weakness and loss of consciousness.

Should a Member wish to notify us of a potential danger to another Member, notify us of an abusive Member, or notify us of posts or User Content that breach our Terms and Conditions or our Forum Standards and Code of Conduct, please email us at: support@spuggz.com.

Use of Forum

Member may NOTuse membership, or allow anyone else to use Member’s account, to post, email, transmit or otherwise make available any of the following:

  • User Content that is abusive, vulgar, obscene, hateful, fraudulent, threatening, or that discloses private or personal matters concerning any person. This includes language (“swear words”), information, or images.
  • Masked vulgarity, obscenity, or profanity (e.g., "f*ck") is acceptable within reasonable limits.  Reasonable limits are determined at the sole discretion of the Spuggz Forum moderators, owners, and directors.
  • User Content that is threatening, harassing, libelous, defamatory, or abusive, either between Members or directed towards a Spuggz/POND/SUFR Forum moderator, representative, affiliate or sponsor.

Member may NOTuse membership, or allow anyone else to use Member’s account, to post, email, transmit or otherwise make available any of the following:

  • "Rants," "slams," or threats of any nature against another Member, Spuggz/POND/SUFR, representatives or moderators, or third-party affiliates or sponsors Spuggz/POND/SUFR.
  • Bigoted, racially, or ethnically offensive comments.
  • Any material that Member doesn’t have the right to transmit under law (such as copyright, patent, trademark, trade secret, securities, or other proprietary rights of any party) or under contractual or fiduciary relationships (such as nondisclosure agreements).
  • Language that promotes illegal activity or discusses illegal activities with the intent to commit them. This includes any message that solicits or promotes the use of an illegal substance.
  • Unsolicited or unauthorized advertising, promotional materials, or other forms of solicitation including chain letters, pyramid schemes, class action suits, charitable appeals, "junk mail", or "spam". This includes advertising links in signatures.
  • Any file or link to a file that contains viruses, corrupted files, "Trojan Horses," or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Duplicate posts, spam messages, or posts repeated excessively on one or more boards, categories, topic, or threads.
  • Messages designed to evade profanity filters or other filters.
  • Personal phone numbers, address, email addresses, private information such as social security numbers, or other contact information that is not Member’s own, including, but not limited to other Members Spuggz/POND/SUFR, representatives, affiliates, or sponsors.
  • Hyperlinks that lead to sites that violate any of the Forum guidelines.
  • Any message that impersonates another Member, person, or affiliation with an entity, including but not limited to other Members and Spuggz/POND/SUFR representatives, affiliates, or sponsors.

Member Posts & Content Submissions

Members are solely responsible and liable for their posts, communications, submissions, and any type of User Content, (and the consequences) made under Member’s name, username, email address, password and Member’s registration and profile information, if any.

Members may submit material for publication with the following understanding and under the following Terms and Conditions:

  • Publication of any material Member submits to us will be posted and shared at our sole discretion.
  • We reserve the right to make Member remove User Content from the recovery Forum or refuse publication.
  • Member grants Spuggz, LLC a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to publish and communicate to the public any material Member submits to Spuggz, in any format, including without limitation print and electronic format.
  • Member warrants that any material they submit is Member’s own original work, or submitted with owner authorization, and that Member owns the copyright and any other relevant rights.
  • Should Member submit material that isn’t Member’s copyright, Members must provide the name and contact information, along with copyright permissions.
  • Member is allowed to post and interact on the Forum so long as the comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party and the comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material which is an invasion of privacy.
  • Member warrants that the material Member submits is not obscene, offensive, or otherwise illegal.
  • Member will take reasonable steps to ensure that any material Member submits is not defamatory of any person.
  • Members agree not to submit material that is deliberately intended to upset or provoke other Members, Forum visitors, or other users.
  • Should a Member suspect that material may be offensive or upsetting, Member must inform Spuggz, at the time of the post or submission, of said materials and include a “Content Warning” at the beginning of the post or submission.
  • Members shall not post or submit personal attacks directed at anyone including toward other Members, Spuggz/POND/SUFR representatives, moderators, affiliates, or sponsors. All forms of discrimination, (religious, personal beliefs, mental or physical disabilities, gender, sexual orientation, race, color, ethnic origin, age, culture, economic, social class, education level, etc.,) or posts that could be interpreted as a personal attack, shall be considered a personal attack.
·         Members shall not post or submit identifying or personal information of another person without their consent, and under no circumstance, personal information regarding a child under the age of 18.
  • Members shall not make posts or submissions to be used to solicit or promote unlawful activity.
  • Members shall not intentionally violate any other applicable law, regulation, contractual or fiduciary relationships (such as by posting inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) while accessing and using the Spuggz/POND/SUFR website, Forums, or other platforms.
  • Members shall not interfere in any way with the operations of the Spuggz/PONF/SUFR programs, services, websites, Forums, or other platforms. including but not limited to mail or "post" bombing, news bombing, other flooding techniques, deliberate attempts to overload a system and broadcast attacks, or attempts to avoid messaging blocking.
  • Members shall not evade bans or suspensions or otherwise disregard directions from Spuggz moderators, administrators, or any Spuggz/POND/SUFR representative.
  • Members shall not harm, stalk, or harass other Members, Spuggz/POND/SUFR representatives, moderators, affiliates, or sponsors, especially minors, in any way.
  • Members shall not impersonate any person or entity, including, but not limited to, other Members, Spuggz/POND/SUFR, representatives, moderators, affiliates, or sponsors, or falsely state or otherwise misrepresent Member’s affiliation with a person or entity.
  • Members shall not forge headers or otherwise manipulate identifiers to disguise the origin of any User Content transmitted through the recovery Forum.
  • Members shall not collect or store personal data about other Members, Spuggz/POND/SUFR affiliates, sponsors, moderators, or representatives.
  • Forum moderators may at any time, and without prior notice, remove any User Content (posted message, comment, image, video, material, or thread), delete words that violate these guidelines, or ban Member’s account for violating these Terms and Conditions.
  • Spuggz/POND/SUFR shall not be held responsible for any User Content that Member submits. Spuggz/POND/SUFR accepts no liability in respect of any material submitted by users and published by us, and we are not responsible for its content and accuracy.
  • Member agrees to protect and defend Spuggz/POND/SUFR against all claims generated from Member’s User Content.
  • No link(s) should appear in any post, submission or interaction that may be interpreted as libelous, obscene, or criminal, or that infringes, otherwise violates, or advocates the infringement or other violation against Spuggz/POND/SUFR, or any third-party rights. Such links shall be removed immediately, and Member’s program and/or Forum access may be suspended temporarily or permanently for repeated infractions.
  • Member acknowledges that any breach of these conditions may cause damage or loss to the Power of 90 Days and Standing Up for Recovery programs and/or platforms, or their parent company, Spuggz, LLC.  Member agrees to indemnify Spuggz/POND/SUFR in full and permanently against any third-party liabilities, claims, costs, loss, or damage we incur as a result of Member’s breach of these Terms and Conditions.
  • Member must act honestly and in good faith in Member’s dealings with Spuggz/POND/SUFR and, if requested, Member must provide us with reasonable assistance to settle, defend or investigate any third-party claims arising as a result of our publication of material Member has submitted to us.
  • We reserve the right to completely remove Member’s access to the Spuggz/POND/SUFR Forum services if we believe Member is abusing the services in any way.

Forum Safety

While our Forums are a great place for interacting and connecting with Members, please keep in mind, cyber-scammers and identity thieves are really skilled at stealing Member information. Practicing online safety can help protect Member.

Take care to avoid sharing ANY personal information that can help Member become a target. This includes, but is not limited to:

  • Phone number.
  • Home address.
  • Email address.
  • Birthdate.
  • Where Member works and work address.
  • Don’t broadcast if Member will be traveling as Member’s vacant home could become a target.
  • Don’t share the name of Member’s pets, schools, favorite colors, etc., because hackers can use this information to access Member’s accounts.
  • Be cautious if a Member is invited to meet someone they don’t know in person.  Don’t invite them to Member’s home. If Members do decide to meet, make sure the meeting place is somewhere public and, if possible, take a friend along.
  • Don't store passwords in Member’s web browser. If a phone, tablet, or laptop is stolen, saved passwords can provide access to social accounts, shopping sites, financial accounts, email, etc.
  • Using strong passwords protect Member’s phone, tablet, or laptop so if they’re lost or stolen, there’s no easy access.
  • If Member suspect personal information has been comprised, change username and password immediately and monitor credit reports for suspicious activity.  
  • Make sure antivirus and/or malware software is up to date.  
  • Use caution if using a hotspot. Hackers use “man in the middle attacks” at coffee shops and other public places. They’re looking to intercept passwords and other private information. Should Member go online at these places, use a VPN (Virtual Private Network) as protection.
  • Don’t click on or follow external links if Member don’t trust them.
  • Protect identity by not using Member’s real name or photo and use an avatar or image and a screen name.

Forum Standards & Code of Conduct

Spuggz is committed to the highest standards of integrity and professional conduct. Members who submit content have a duty to ensure that their submissions are respectful, honest, and true.

Spuggz always strives for fairness and accuracy, and we encourage Members to advise us of any significant errors or areas of concern.  Should a Member appear to be a danger to themselves or others, please call 911, or notify us immediately. Members can notify us at support@spuggz.com.

Spuggz wants its Forums to be a place for respectful, helpful, and supportive discussions and interactions that are intended to support all types of recovery. While Spuggz has a firm commitment to freedom of speech, we also want our Members to behave in a courteous, respectful, and truthful manner.

Following these guidelines will help Members adhere to our Forum Standards and Code of Conduct.

  • Don’t attack people online, and don’t respond to attacks.
  • Report attacks at support@spuggz.com
  • Keep posts, comments, interactions, and uploads, on topic and constructive.
  • Respect others and their opinions, personal views, personal histories, and situations. Treat people with the same respect Member would like to receive for opinions, personal views, personal history, and situation. Members may come across opinions and personal views they disagree with. That doesn’t make them invalid. Ask the author why they feel or believe the way they do.
  • Be considerate. We’re here to talk about ideas, experiences, and potential solutions, not the people behind them.
  • Admit when you’re wrong.
  • Explain why Member disagrees or agrees with something. Members’ reasoning is as important as their opinion.
  • “This article sucks” will be deleted. “I disagree with this article. Here’s why…” won’t be.
  • ” So and So” is an idiot” will be deleted. “Has Member considered…?” won’t be.
  • Back up ideas, suggestions and observations with evidence and facts where possible. If you’re claiming something as scientific or proven fact, try to provide credible references.
  • If Member disagrees or needs clarification on a post, respectfully ask the author for more information.
  • Aim to add a new idea to each approach rather than simply repeating what’s already been said.
  • Spuggz/POND/SUFR Forum moderators will distinguish between constructive comments and smear campaigns. We will remove any deliberate attempts to misinform, distort facts or misrepresent the opinions of others. We will delete personal attacks directed at anyone; all forms of discrimination (or posts that could be interpreted as such); posts we believe exist only to provoke or mislead; posts identifying or sharing the personal information of another person without their consent; and comments that are commercial or repeatedly shared external links.
  • Under no circumstances should personal information be shared regarding a minor (a child under the age of 18), including, but not limited to, name, age, address, name of parents or siblings, birthdate, school, situation, photos, images, videos, etc.
  • Don’t post anything that may put Spuggz/POND/SUFR in legal jeopardy – nothing defamatory, libelous and nothing in breach of copyright protections.
  • Be proactive. Take responsibility for the quality of the conversations you participate in; only reply to things you consider worth your attention.
  • Report posts you think violated this Forum Code of Conduct and notify Spuggz at support@spuggz.com.
  • Let other Members know when you like and appreciate a post or submission.
  • We reserve the right to remove comments and User Content that breach these standards and lock accounts of commenters who breach them repeatedly.
  • Replies to comments that have been deleted may themselves be deleted, either to remove the thread or because they don’t make sense out of context.
  • Members who report false alerts will have their membership suspended or permanently deleted.

Moderators & Reporting Abuse

All Forum interaction is subject to moderation to help ensure the integrity of the Forum standards is upheld. Although our moderators and Forum representatives will try to keep an eye on all Forum activity, we also rely on our Members to report abusive, offensive, or otherwise inappropriate User Content (comments, posts, images, videos, materials) or any User Content, by alerting us of problems and areas of concern to the Forum.  This allows us to make the Forum better for everyone.  Member can notify us via email at: support@spuggz.com.

Members who seriously, persistently, or willfully ignore our Forum Terms & Conditions and/or Code of Conduct, will lose their posting privileges and their membership will be cancelled. This is not an action that we take lightly or arbitrarily. However, it is our intent to provide an online experience consistent with the high value we place on civilized interaction and communication, and we reserve the right to make decisions we feel support that.

Our moderators are directed to enforce our Forum Terms & Conditions and Code of Conduct, and to create a constructive environment for everyone who contributes to our Forum.  Therefore, any advice or request from our moderators regarding Forum interaction should be respected and followed. 

In the interest of keeping our recovery Forum appropriate and supportive for the majority of our Members, we will, when necessary, remove User Content.  If a post or submission is perceived as breaching the Forum Standards and Code of Conduct as set out above, or our Terms and Conditions, that post, or submission will be removed by the moderators.    

We will not edit Member posts to change the meaning, spelling, or anything else intended by the Member. Even if only part of a comment or posting is perceived as breaching community guidelines, the entire content may be removed.

When User Content is removed for any of the reasons above, it is sometimes necessary to delete subsequent messages that refer to explicitly or quote from the original (removed) comment to preserve the conversational thread. This may also happen because a later comment is directly related to the problematic sections of the original comment, which would perpetuate the problem. In such cases, not every deletion will be marked individually.

We reserve the right to take steps or implement measures that we hope will benefit the whole community of Members.

Liability for Member Content & Member Communications

Member acknowledges that, to allow for the free flow of information and shared experiences by its Members, Spuggz, LLC does not prescreen User Content before it is posted or uploaded to the Forum site.  Therefore, in accordance with the Communication Decency Act, Section 230, and the Digital Millennium Copyright Act, Spuggz, LLC cannot and does not accept any liability for User Content that infringes on copyrights or rights-to-use,is offensive, or hurtful, or that may cause a trigger or emotional distress.

However, Spuggz, LLC does provide moderators to help maintain the integrity of the recovery Forum to the best of our ability. Additionally, Spuggz, LLC and its moderators shall have the right (but not the obligation) in their sole discretion to refuse or remove any User Content that is posted or submitted via the Forum site, or on any of our platforms.

Under no circumstances shall Spuggz, LLC have, or be construed to have, any responsibility or liability for or in connection with any User Content submitted by Member including, but not limited to, for any errors or omissions in any content or materials, or for any loss or damage of any kind incurred as a result of the use of any content or materials posted, emailed, transmitted, or otherwise made available via the Forum.

To protect the integrity of the Forum, legal, moral, and liability standards set by Federal law or Spuggz, LLC, if we determine Member has not met the minimum age requirement of 13 (or does not have the permission of a parent or legal guardian if under the age of 13) (See the Children's Online Privacy Protection Act below), or if, in our judgment, Member submits User Content, that violates these Forum Agreement and Terms and Conditions, or the Forum Standards and Code of Conduct, for any other reason, we reserve the right, at any time, without notice and without limiting any and all other rights we may have under this Forum Terms & Conditions, at law or in equity, to:

(a) refuse to allow Member to make additional posts or to submit additional User Content (b) remove and delete Member’s posts or submissions, (c) revoke Member’s registration/membership and right to use the Forum and its services and (d) use any technological, legal, operational or other means available to enforce the terms of this Forum Agreement, including, without limitation, blocking specific IP addresses or deactivating Member’s registration/membership, including Member’s email address, username and password.

Liability Indemnity

Member agrees to indemnify, defend and hold harmless, Spuggz/POND/SUFR , its subsidiaries, affiliates, and sponsors, and each of its representatives, directors, clients or other partners, and employees, from any claim or demand, including  legal fees, made by any third party due to or arising out of User Content and/or materials submitted, posted, transmitted or make available through the Forum, Member’s use of the Forum site, Member’s connection to the Forum site, Member’s violation of the Terms & Conditions, or Member’s violation of any rights of another.

Member hereby releases Spuggz/POND/SUFR and its representatives from any and all claims of any rights, encumbrances, liens, claims, demands, actions or suits which Member may or can have in connection with Member’s submitted User Content and/or materials, including, without limitation, any and all liability for any use or nonuse of the Member’s user content and/or materials, claims for defamation, libel, slander, invasion of privacy, right of publicity, emotional distress or economic loss.

Any unlawful or disparaging action caused by Member regarding membership and interaction within the Forum, including Member’s participation within categories and conversations conducted by Spuggz/POND/SUFR and/or its Members, that may be considered a violation of criminal and/or civil law shall entitle Forum to seek all remedies in this regard to the full extent permitted by law and in equity. Forum disclaims any warranties, express and implied, related to Member’s membership within the Forum site and to Member’s participation within categories and conversations conducted by Forum and/or its Members, and shall have no liability whatsoever, including, without limitation liability, for any indirect, special, incidental, or consequential damages, to Member or any third party, for Member’s  actions and/or interactions within the recovery Forum site.

Member will release and forever discharge Spuggz/POND/SUFR , its representatives, directors, employees, affiliates, and sponsors, from and against all claims, lawsuits, causes of action, demands, losses, liabilities, obligations, judgments, damages, costs, and expenses of any kind, arising directly or indirectly out of any injury, death, or other damage sustained or allegedly sustained by Member resulting from the participation and membership of the Forum. 

Rights & Permissions Granted to Spuggz, LLC

In connection with all User Content, comments, content, images, videos and/or materials Members submit to us, Member grants to Spuggz, LLC, the unqualified, unrestricted, unconditional, unlimited, worldwide, irrevocable, perpetual and royalty-free right, license, authorization and permission, in any form or format, on or through any media or medium and with any technology or devices, in whole or in part, to host, cache, store, maintain, use, reproduce, distribute, display, exhibit, perform, publish, broadcast, transmit, modify, prepare derivative works of, adapt, reformat, translate, make, sell, re-sell, distribute and otherwise use all or any portion of Member’s User Content and/or materials on any of our channels, services, and other distribution platforms, whether currently existing or developed in the future, for any purpose whatsoever, including, without limitation, for any promotional purposes, without accounting, notification, compensation, credit or other obligation to Member, at our sole discretion.

For the avoidance of doubt, without limiting the generality of the rights granted to Spuggz, LLC, these rights include, without limitation, the right to distribute and synchronize all or any portion of Member’s User Content and/or materials in timed relation to any other visual elements; to webcast, podcast, republish, rebroadcast, syndicate, route, and link to and from all or any portion of Member’s User Content and/or materials, on any of our media platforms and venues.

The rights, licenses and privileges described in these Terms and Conditions granted to Spuggz, LLC, shall commence immediately upon submission of Member’s first Forum post and continue thereafter perpetually and indefinitely, and will automatically renew each time a Member makes another post, submission, or Forum interaction, regardless of method or address of submission (for example, Forum post, or an email to Spuggz or a Spuggz social media site). Regardless of whether a Member continues or remains a registered Member or not, these rights, licenses and privileges shall continue in perpetuity, unless and until terminated, in whole or in part, by Spuggz, LLC, on notice to Member.

Notwithstanding the foregoing, Member acknowledges and agrees that Spuggz, LLC shall not be required or have any obligation to host, index, display, accept or use any submitted User Content or materials (or take advantage of any or all of the particular rights and authorities granted or otherwise available) and that Spuggz, LLC may, in its sole discretion, remove or refuse to host, index, display, accept, use or do anything at all with respect to any User Content or materials.

Once a Member submits, or attempts to submit, User Content, Member shall have no right to prohibit, restrict, revoke, or terminate any of the rights granted to Spuggz/POND/SUFR .  Member may request to terminate the rights of Spuggz/POND/SUFR , by submitting a request via email at support@spuggz.com.

Once User Content has been submitted by a Member, Member is not entitled to and shall not receive any compensation or other consideration for Member’s User Content and/or materials, or any use made of Member’s User Content and or materials. Member also understands and agrees that Spuggz/POND/SUFR is not required to obtain preapproval from Member before utilizing any portion, in whole or in part, of Member’s User Content and/or materials.

Spuggz, LLC shall have the right to assign, transfer, convey, license, sublicense and otherwise transfer, subcontract, delegate, outsource or engage third parties to perform or benefit from all or any portion of their rights and/or obligations to any one or more other parties, without accounting, reporting, notification or other obligation or liability to Member whatsoever, now or in the perpetual future.

Spuggz, LLC has the right to license, authorize and/or otherwise enter into agreements and arrangements with any third party to do or perform any of the activities, exercise any of the rights and/or undertake any of the responsibilities granted or imposed under this Forum Agreement, in whole or in part. To the extent Spuggz, LLC does so, when Member submits User Content and/or materials, each such third party shall be entitled to exercise and benefit from these Terms and Conditions, rights, licenses, and authorizations granted to Spuggz, LLC hereunder and related thereto as if Member had entered into these Forum Terms & Conditions with such third party directly.

We may allow Member to submit User Content through our Forums, blogs, message boards, social networking environments, content creation tools, gameplay, social communities, e-mail, messaging, and other methods of communications we provide. Each time Member posts, uploads, or submits User Content (or attempts to do so), Member is considered to be reconfirming and renewing their acceptance of, and agreement to be bound by, all the Terms and Conditions of this Agreement, regardless of the method of communication, submission, or venue.

Spuggz, LLC reserves the right to review any submitted User Content and to delete, remove, move, edit or reject, without notice to Member, any User Content that we deem, in our sole discretion, abusive, defamatory, obscene, pornographic, in violation of copyright, trademark or other intellectual property rights, to be in violation of these Forum Terms & Conditions or to be unacceptable to Spuggz, LLC, for any reason or for no reason whatsoever; provided, however, that Spuggz, LLC shall have no obligation or liability to Member for failure to do so or for doing so in any particular manner.

If Spuggz, LLC receives notice of any claim of infringement that satisfies specific legal requirements, such as notice and takedown requirements under U.S. copyright law, we may remove User Content associated with such claim. Spuggz, LLC reserves the right to provide information to law enforcement officials, governmental agencies and, pursuant to judicial or regulatory compulsion, to protect their respective interests, their services or to comply with legal, regulatory, audit and compliance obligations.

License & Ownership

Unless otherwise stated, Spuggz, LLC owns the intellectual property rights for all User Content on the Forum. All intellectual property rights are reserved.

Except where the Member already owns the rights, Member is not allowed to:

  • Republish material from the Forum or any of the Spuggz/POND/SUFR websites, Forums, or platforms.
  • Sell, rent or sub-license material from the Forum or any of the Spuggz/POND/SUFR websites, Forums, or platforms.
  • Reproduce, duplicate, or copy material from the Forum or any of the Spuggz/POND/SUFR websites, Forums, or platforms.
  • Redistribute content from the Forum or any of the Spuggz/POND/SUFR websites, Forums, or platforms.

Spuggz, LLC retains all rights, title, and interest in and to the recovery Forum and its services, including, without limitation, to all associated intellectual property and proprietary rights existing anywhere in the world and Member acquires no right, title, or interest in or to the Forum or the Spuggz/POND/SUFR platforms.

Except for the licenses, authorizations, consents, and rights granted hereunder and described in this Forum Agreement, as comprehensive and broad as they may seem or actually be, Spuggz, LLC acquires no title or ownership rights, except the perpetual right-to-use as detailed in this Agreement, to any User Content where Member owns the rights or copyrights.

Nothing in this Forum Agreement conveys to Spuggz, LLC, any ownership rights in Member’s User Content, except to the extent Member’s User Content incorporates copyrighted materials of Spuggz, LLC. Spuggz, LLC is acting only as a host, bulletin board or conduit for submitted User Content, with all of the specific rights granted by Members hereunder. Although, by Member’s submission of any User Content, Member is requesting and directing Spuggz, LLC, and any of the third-party affiliates with whom we have made arrangements, to take advantage of and exploit all of the rights and privileges granted hereunder, including, without limitation, the right to display, publish and post the User Content on any of our platforms, through any type of media, neither Spuggz, LLC, nor any of our third-party affiliates have any obligation to do any of these things.

Member represents that they own the rights to the User Content they submit and the right to grant all of the authorizations, permissions, approvals, consents, rights, and licenses as described in this Forum Agreement. If Member does not exclusively own all of these rights, Member must have all necessary authorizations, permissions, approvals, consents, rights, and licenses from the owner(s) to make the submission on the Forum.

Members understand and accept that Members will not be entitled to any compensation because of the use or exploitation thereof and the submission of User Content, even if Member subsequently sees or learns of a publishing venue such as a brochure, book, or magazine, a motion picture, still photograph, film, video or any other form of presentation that appears to incorporate any idea or concept or include anything similar or identical to that contained in any User Content that Member submits.

Spuggz, LLC reserves the sole and exclusive right to sell crowdfunding,  advertising and sponsorships, and multiple types of publications with the intention of  exploiting and benefiting from and/or realizing revenue from the conduct of its business and operating the recovery Forum and its affiliated services or other platforms or media and any and all arrangements made with respect thereto, without accounting, compensation, obligation or liability to Member, notwithstanding that Member’s User Content may be displayed on or otherwise used by or in connection with the recovery Forum and its affiliated services or other platforms, media or venues.

Members shall not receive any compensation for Spuggz, LLC use of Member’s User Content, unless expressly pre-approved by Spuggz, LLC.

No Resale of Service

Member agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Forum or any of the Spuggz/POND/SUFR platforms, including but not limited to the websites, User Content, social media, and recovery programs, including Member’s Forum username, User Content, or materials within the Forum site, use of the Forum site, or access to the Forum site.

Disclaimer of Warranties & Guarantees

Member expressly understands and agrees that:

  • Member’s use of the Forum is at their sole risk.  The recovery Forum service is provided on an “As Is” and “As Available” basis and is intended to be used as an open and free platform for registered Members to share stories, opinions, views, ideas, experiences, and potential solutions and resources for addiction, depression, anxiety and trauma recovery, aftercare, and support. Spuggz, LLC expressly disclaims all warranties and guarantees of any kind, whether expressed or implied, including but not limited to success or rate of recovery.
  • Spuggz, LLC makes no warranty or guarantee that the recovery Forum will meet Member’s requirements or expectation that:

o   The Forum site will be uninterrupted, timely, 100% secure, or error-free (Although we will do everything within our power to maintain the availability, security, and accuracy of our site).

o   The results from the Forum will meet the Member’s requirements or expectations.

o   The information on the Forum will always be accurate or reliable.

o   That participation in the Forum will result in partial, complete, or continued results as desired by Member.

o   The quality of information, products or services provided on or made available through the website, program, or Forum will meet Member’s requirements or expectations.

  • Any errors in the software will be corrected in a timely manner, or not at all, if error doesn’t create a negative impact on the site or Member’s ability to use site.
  • Any information or materials downloaded, or otherwise obtained through the websites or Forums, is done at the Member’s sole discretion and risk and that the Member will be solely responsible for any damage done to Member’s computer or digital system or loss of data that results from the download of any such information or material.
  • No advice or information, whether oral or written, obtained by Member through the recovery site or Forum moderators, representatives, or owners, shall create any warranty or guarantee not expressly stated in these Terms and Conditions.
  • No advice or information, whether oral or written, made available through the recovery Forum or the Spuggz programs, should be considered legal or medical advice.
  • Spuggz, LLC assumes no responsibility or liability for information, advice or recommendations posted on the Forum, regardless of whether the individual making such post is a professional or not.

This Act protects children's privacy by giving parents tools to control what information is collected from their children online. MEMBER ACKNOWLEDGEMENT & ACCEPTANCE

Member hereby releases, waives, and forever discharges Spuggz/POND/SUFR, its representatives, employees, coaches, agents, successors, and assigns from every claim, suit, legal demand, or right to compensation for damages Member may claim to have, or that Member may have arising out of acts or omissions by Spuggz or its representatives, resulting from the interaction and engagement of the Spuggz forums contemplated by this Agreement.  Each Member further declares and represents that no promise, inducement, or agreement not expressed in this Agreement has been made to Member to sign this Agreement. By clicking “Register Now”, Member affirms they have read this Forum Agreement, understand, and accept the terms & conditions contained herein.  Members reaffirm acceptance & understating of these Forum Terms & Condition every time they use a Spuggz/Power of 90 Days/Standing Up for Recovery Forum.
